Summit & Shore Alliance – Participant Assumption of Risk, Liability Waiver & Media Release

In consideration for being permitted to participate in outdoor, boating, or water-based activities hosted or facilitated by Summit & Shore Alliance, a 501(c)(3) nonprofit (“SSA”), I hereby acknowledge and agree as follows:

1. Assumption of Risk

I understand that participation in boating, jet-skiing, and other outdoor recreational activities involves known and unanticipated risks that could result in injury, illness, property damage, or death. These risks include, but are not limited to:

• Equipment failure or malfunction of boats, jet skis, or other watercraft;

• Collisions, capsizing, sinking, grounding, or flooding;

• Risks from wakes, waves, or changing weather and water conditions;

• Hazards such as docks, shorelines, submerged or floating objects, wildlife, or debris;

• Exposure to heat, sun, wind, rain, lightning, or severe weather;

• Slips, trips, or falls while boarding, disembarking, or on vessels;

• Operator error or negligence by myself, SSA, or others;

• Delayed medical response in remote areas.

I understand that I am participating voluntarily and agree to act responsibly and in accordance with SSA’s safety instructions and mission of respect, community, and stewardship.
I freely and voluntarily assume all risks of participation, including those arising from negligence.

2. Waiver and Release of Liability

I, for myself and any minors listed below, hereby waive, release, and discharge Summit & Shore Alliance, its affiliates, employees, officers, directors, volunteers, and contractors from any and all claims or causes of action for personal injury, property damage, illness, or death arising from my participation in SSA activities or events.

This release includes any claims of negligence but excludes claims not legally waivable under applicable state law.

3. Participant Responsibility

I agree to follow all instructions from SSA staff and volunteers and to behave safely and respectfully at all times. I understand that participation is a privilege, not a right, and that failure to adhere to safety guidelines may result in removal from the activity.

I am responsible for my own actions and for any damage I may cause to persons, property, or equipment during participation.

4. Indemnification

I agree to indemnify and hold harmless SSA, its partners, and representatives from any and all losses, liabilities, or expenses (including attorney’s fees) arising out of my participation, conduct, or breach of this Agreement.

5. Insurance Acknowledgment

I certify that I have adequate medical and liability insurance or the financial means to cover any injury, damage, or loss I may cause or sustain. I understand that SSA does not provide health, medical, or liability insurance for participants.

6. Media & Appearance Release

I grant Summit & Shore Alliance, its affiliates, and designees the irrevocable right to record, photograph, film, and/or otherwise capture my image, likeness, voice, and statements (collectively, “Likeness”) during any SSA event or program.

SSA may use these recordings in any form of media, now known or later developed, for promotional, educational, documentary, or fundraising purposes related to its mission.

I understand and agree that:

• No compensation is or will be due for such use;

• I waive all rights of inspection or approval;

• My image or voice may be edited or combined with other materials;

• I release SSA and its representatives from all liability arising from the use of my likeness, statements, or participation in media.

7. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the state in which the activity occurs. Any dispute shall be resolved through confidential binding arbitration in accordance with that state’s laws.

8. Severability and Binding Effect

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be binding upon my heirs, executors, administrators, and legal representatives.

9. Acknowledgment and Acceptance

I have carefully read and fully understand this Agreement. I acknowledge that by signing below, I am voluntarily waiving substantial legal rights, including the right to sue. I sign freely and voluntarily, intending to be legally bound.
